GOP Senator Jerry Moran Raises Red Flags Over CLARITY Act

Senator Jerry Moran said that he will not support the CLARITY Act unless it is amended to address concerns raised by the banking sector.

The Kansas Republican said he is “unable to support the Clarity Act in its current form until there’s a satisfactory and different outcome than where we are now in regard to its … consequences on the people who rely upon banks in small towns across Kansas.”

Moran, who has been a longtime supporter of community banks, is the second GOP senator to vote against the bill in its current form as lawmakers work on any new version of the crypto bill.

CLARITY Act Misses Weekend Vote as Senate Skips Cloture Filing

On Thursday, the U.S. Senate made no attempt to bring the CLARITY Act to a floor vote. This suggests that it is unlikely a procedural vote will take place this weekend and delaying the crypto market structure bill further down the Senate calendar.

The Senate Press Gallery posted the daily schedule, which would have the chamber reconvene at 10:00 a.m. Thursday to “resume consideration of the nominations in bloc, pursuant to S Res 817, post-cloture.” The release added that “roll call votes are expected but have not yet been scheduled.”

However, the CLARITY Act was not on the agenda at all.

The Senate won’t be able to start the process they need to move the bill to a vote this week until a cloture petition is filed. The late filing eliminates the possibility of a weekend vote to close the door on the filings, which is typical procedure in the current Senate session. Read More.

Elizabeth Warren Ditches CLARITY Act Floor Vote Over ‘Corruption’ Concerns

Senator Elizabeth Warren reiterated her objections to the CLARITY Act, saying it has problems that remain so far.

“They’ve still not solved the problem of corruption, of consumer protection, of national security, or protecting our economy,” Warren said. She added that “until you solve those problems, I just don’t see how anyone, Democrat or Republican, moves forward on this bill.”

Warren has been one of the Senate’s most vocal critics of the crypto market structure proposal. She has said the crypto bill she is lacking hasn’t adequate protections for consumers and the financial system.

CLARITY Act Senate Vote Still Possible As August Recess Deadline Nears

The Senate is running out of time to move the CLARITY Act before going on recess in August. Senate Majority Leader John Thune hasn’t submitted a cloture motion and talks on the ethics rules are ongoing. Filing cloture on Thursday would be a last hurdle to a procedural vote this week, if senators wish to do so.

The delays haven’t stopped Senator Cynthia Lummis from suggesting the Senate might continue session past its recess. This indicates that policymakers could keep going to ensure that the crypto market structure bill moves forward for a vote.
